난민이란 본국에서 생존과 권리를 침해당하여 타국으로 가 스스로를 보호하는 자를 말하는데요.

A refugee refers to a person who goes to another country and protects himself/herself due to infringement of his/her survival and rights in his/her home country.

 

난민으로서 한국에 체류하기 위해서는 난민신청을하여 허가를 받아야 합니다.

To stay in Korea as a refugee, you must apply for refugee status and obtain permission.
 

대한민국에 난민법이 제정된 것은 2012년으로 벌써 10년이 지났지만, 아직도 난민에 대한 내국인들의 인식은 너그럽지 못합니다.

It has already been 10 years since the Refugee Act was enacted in Korea in 2012, but Koreans' perception of refugees is still not generous.
 

실제로 난민신청을 하여 허가받는 수는 전체 신청자의 1%에 가깝다고 하죠.

In fact, it is said that the number of people who apply for refugee status and get permission is close to 1% of all applicants.
 

한국에서 난민으로 인정받지 못한다면 본국으로 돌아가 생명에 위협을 받을지도 모르는 일입니다.

■ 난민심사 언제 받게 될까?

When do I be screened for refugee status?
 

난민심사를 받기 위해서는 당연히 신청부터 하여야 합니다.

Of course, you must apply first in order to be screened for refugee status.

 

난민신청은 그 신청일에 따라 구분되는데요.

Refugee applications are classified according to the date of application.
 

1.    한국 입국 전에 난민신청 

Apply for refugee status before entering Korea 

2.    한국 입국 후 (체류 중) 난민신청

Application for refugee status (staying) after entering Korea
 

 

아직 한국에 입국하지 않았을 때 난민신청을 한다면, 한국 공항에 도달한 이후 입국심사를 받기 전에 난민심사를 받을 자격이 되는지 관해 또 다른 심사를 받게 됩니다.

If you apply for refugee status when you haven't entered Korea yet, you'll get another examination to see if you're eligible for refugee status before you go through immigration after arriving at the Korean airport.
 

이 때 반드시 제출해야 하는 내용으로는 여권, 외국인등록증, 난민인정신청서, 난민심사에 고려할 만한 자료 등이 있습니다.

At this time, the contents that must be submitted include passports, alien registration cards, applications for refugee recognition, and materials that can be considered for refugee screening.
 

본인이 난민이 될 수밖에 없었던 사유를 충분한 자료로 증명해 준다면 심사에 큰 도움이 될 것이며, 난민신청 이후 일주일 내에 난민심사를 진행할 것인지 여부가 판단됩니다.

If you prove the reason why you were forced to become a refugee with sufficient data, it will be of great help to the examination, and it is judged whether or not you will proceed with the refugee examination within a week after applying for refugee status.
 

이미 한국에 입국한 이후에 난민심사를 받고 싶다면 출입국사무소 혹은 외국인보호소에서 진행하실 수 있는데요.

If you want to be screened for refugees after entering Korea, you can proceed at the immigration office or the foreigner protection center.

많은 난민들이 의사소통에 어려움을 겪습니다.
급작스럽게 본국을 탈출하여 향한 나라니, 제대로 된 한국어를 배울 엄두도 내지 못한 경우가 많죠.

그렇다면 본인이 난민심사를 받기 위해 굳이 설명할 필요 없는 말, 불리한 말을 가려내지 못할 경우가 많습니다.

심사는 난민신청 이후 반년 내에 결정되며, 혹시 난민심사가 불안하거나 불허가 판정을 받아 곤란하다면 최대한 빨리 연락주시기 바랍니다.

The screening will be decided within half a year after applying for refugee status, and if the refugee screening is unstable or difficult due to the disapproval, please contact us as soon as possible.

■ 난민심사에서 불허가 판정을 받았다면?

난민신청을 하여 심사를 받았는데 난민불인정결정통지서를 받게 되었나요?

난민심사 전후로 변호사의 검토를 받아 보시면 좋은데요.

본인이 제출한 자료에 오류기 있었거나 말하지 않은 내용이 작성되는 등 진술에서부터 난민 차별에 시달리셨을 가능성도 있습니다.

There is a possibility that you suffered from refugee discrimination from your statements, such as errors in the data you submitted or unsaid.
 

우선 난민불인정결정통지서에 기재된 사유를 분석하여 30일 이내에 이의를 제기해야 합니다.

First of all, you must analyze the reasons listed in the notice of refugee disapproval and file an objection within 30 days.
 

이의제기 이후 행정심판을 청구하여 난민심사의 결과가 불합리하고 납득 불가느한 사유를 설명해야 하겠지요.

After the objection, an administrative trial should be requested to explain the reasons why the results of the refugee screening are unreasonable and unconvincing.
 

이의제기는 지방에 위치한 출입국사무소, 외국인관서 등에서 가능하며 신청 이후 반년 내에 난민허가 판정이 이루어질 것입니다.

Objections can be filed at immigration offices and foreign offices located in the province, and a refugee permit decision will be made within half a year after the application.
 

만약 반년 이내에 특별한 사정에 의해 결론이 지어지지 않는다면 기간이 늘어날 수 있습니다.

If a conclusion is not made due to special circumstances within half a year, the period may be extended.
