If you were imprisoned in a foreigner shelter in Korea

Have you heard about the foreigner shelter in Korea?

It is a place to imprison foreigners who have been ordered to leave the country forcibly and those who have committed illegal in Korea.

They say they're issuing a "protection order," but they're actually not protecting them, they're putting them in jail.

As of 2021, more than 3,000 foreigners have been ordered to deport in Korea, and if foreigners who committed crimes and illegal immigrants who were arrested are included, a much larger number will be imprisoned.

But there are only two foreigner shelters in Korea.

The facility of foreigner shelters is very poor, that the controversy over human rights violations in foreigner shelters has continued.

■ Request for temporary release of protection and a lawsuit for revocation of protection order

First of all, you need to claim the temporary release of protection.

It is difficult to easily prepare for objections, lawsuits, and voluntary departure within foreigner shelters.

It is also difficult for an acquaintance outside the shelter to prepare the necessary materials.

Therefore, it is necessary to temporarily release the imprisonment in the foreigner shelter.

Being imprisoned in a foreigner shelter means that the Ministry of Justice has determined that the foreigner is likely to repeat a crime or flee.

You have to prepare and apply for logical data to refute that judgment, and it is usually not accepted.

Also, this claim can only be made by a foreigner himself or his immediate family or legal representative (lawyer).

If you are an acquaintance of a third party friend, lover, etc., you cannot claim it.

After your claim is accepted, you will have to pay a deposit of up to 20 million won.

Another option is to proceed with a lawsuit to cancel the protection order.

The request for temporary cancellation of protection is only for "temporarily" lifted to prepare for departure or the lawsuit.

And the lawsuit claims that the protection and departure orders issued to foreigners are unfair and should be canceled.

The lawsuit for cancellation of the protection order is classified as an administrative lawsuit, and if the lawsuit is won, all expenses will be borne by the defendant, immigration office.

You need to claim why is it not necessary to impose a protection order on the foreigner, and how enormous damage can the foreigner get by protection order.

Unless there are reasons such as pregnancy, childbirth, or disease, it may be difficult to persuade the court.

■ There is a Teheran Foreigners/Immigration Center in Korea.

If a foreigner is involved in a crime, a criminal attorney will first provide legal help with the criminal procedure and help foreigners not be fined more than 3 million won.

If the cumulative fine is more than 5 million won or more than a certain number of times over a few years, he can be subject to deportation or imprisonment in a foreigner shelter.

You need appropriate legal help of a criminal attorney with more than 10 years of experience.

And if you go into the administrative stage, the attorney in charge of administrative litigation at the Center for Foreigners/Immigration center in Teheran will lead the case.
